Terms of Service

This page sets out the terms on which we provide this website and, in outline, the capacity in which we arrange freight. Specific shipment terms are governed by the contract and transport documents issued for that shipment.

01Agreement to these terms

These terms apply to your use of logisticsol.com, which is operated by Logistics Solutions, a freight forwarding company based in Ft. Lauderdale, Florida. By using the site you agree to them. If you do not agree, please do not use the site.

Using this website is not the same as booking a shipment. Freight services are provided under a separate contract and under the documentation issued for each shipment, and where anything in that documentation differs from what is written here, the documentation governs.

02What we do, and in what capacity

We arrange the movement of goods — sea, air and road freight, customs brokerage, warehousing and related services — for business customers.

The capacity in which we act on a given shipment, for example as a forwarder arranging transport with third-party providers or as a contracting carrier, is set out in the booking confirmation and the transport documents issued for that shipment. That documentation, rather than this website, determines the responsibilities we take on.

Service descriptions, coverage information, transit times and similar figures published on this site are indicative and provided for general guidance. They are not an offer, a quotation, or a guarantee of a particular outcome.

03Using this website

You may use this website to learn about our services and to contact us about a shipment. Please do not interfere with the site or its security, access it by automated means that place an unreasonable load on it, submit false or misleading information through our forms, or use it for any unlawful purpose.

The text, images, layout and branding on this site belong to us or to our licensors and may not be copied or reproduced for commercial use without permission.

04Quotations and pricing

A quotation is an estimate based on the details you give us, assumes those details are accurate, and is valid only for the period stated on it.

Charges can be affected by matters outside our control, including carrier and fuel surcharges, currency movements, customs duties and taxes, demurrage, storage and re-delivery charges, and corrections following the re-weighing or re-measuring of cargo. Duties, taxes and official charges are payable in addition unless the quotation says otherwise.

Submitting the quote form is a request, not a booking. A booking exists only once we confirm it in writing.

05Booking, documentation and trading conditions

Each shipment is governed by the booking confirmation, the transport documents issued for it, and any standard trading conditions identified as applying to it. Those conditions are identified in the documentation issued for the shipment and are available from us on request.

Where a shipment moves under a bill of lading, air waybill or similar transport document, the terms of that document apply to the carriage it covers.

06Liability

We take care in arranging shipments, but responsibility for loss of, damage to, or delay of cargo is determined by the contract and the documentation issued for that shipment, by any trading conditions identified as applying to it, and by the mandatory law and international rules governing the mode of transport used. Claim notification deadlines are typically short, so please tell us as soon as you become aware of a problem.

Cargo insurance is not automatically included. If you want cover for the value of the goods, ask us before the shipment moves and we will explain the options available for that route.

This website is provided as it is. We do not warrant that its content is complete, current or error-free, and, to the extent the law allows, we are not liable for loss arising from reliance on the general information published here rather than on a written quotation, booking confirmation or transport document.

07Your obligations as a customer

You are responsible for the accuracy and completeness of the information you give us, including descriptions, weights and dimensions, values, classification codes, addresses and the parties involved.

You are also responsible for packing the goods adequately for the journey, for declaring dangerous, restricted or temperature-sensitive cargo before it is booked, and for obtaining any license, permit or authorization the shipment requires.

Misdeclared or undeclared cargo can lead to fines, delays, refused carriage and additional charges, and can put other cargo and the people handling it at risk.

08Payment

Charges are invoiced as set out in the quotation or booking confirmation and are payable by the due date shown on the invoice. Where part of an invoice is disputed, the undisputed balance remains payable.

Late payment may lead to the suspension of services and to charges permitted by law or by the applicable trading conditions. Standard trading conditions in this industry commonly give a forwarder rights over goods and documents in its possession in respect of unpaid sums; where such conditions apply to your shipment, those rights apply.

09Governing law and disputes

These website terms are governed by the laws of the State of Florida, United States, and any dispute relating to them will be dealt with by the courts of Florida.

Where a shipment is governed by trading conditions or by an international transport convention that specifies a different law or forum, that specification takes precedence for that shipment.

Nothing in these terms limits any right you have under law that cannot be excluded by agreement.

10Changes and questions

We may update these terms as our services change. The version published on this page at the time you use the site is the version that applies.

These terms are a general template prepared for our website and will be reviewed by our legal counsel before they are finalized — questions are welcome at contact@logisticsol.com.
